Landlord Terms and Conditions

Landlords agree to provide WFU students with a copy of these terms and conditions as an attachment to their lease.

1. The Landlord agrees to operate and lease in accordance with all applicable local, state, or federal laws; housing ordinances; zoning regulations; and these terms and conditions.
2. The Landlord understands that only students who have fulfilled, or been released from, the residency requirement are eligible to live off-campus.
3. Students will be provided with a letter noting the term in which they are released from the University’s residency requirement and/or are expected to be eligible for off-campus living.
4. The Landlord acknowledges that students are only eligible to sign leases with Registered Landlords and that students must register their address with Residence Life and Housing.
5. The Landlord shares the University’s expectation that all students occupying the property must comply with all applicable local, state, or federal laws; housing ordinances; zoning regulations; and University policies.
6. The Landlord acknowledges that the University maintains the right to serve as the final authority on issues related to violations of University policies.
7. The Landlord and students understand that the University may amend policies or implement new policies from time to time, without prior notice, and that they are required to comply with all changes or new policies when effective.
8. The Landlord understands that violation of University policies may cause students to become ineligible to live at a specific property-type or off-campus during the term of a lease. In these circumstances, a notice of ineligibility will be sent to the student and the Landlord.
9. By entering into a lease with students, the Landlord agrees that upon notice of ineligibility, the student’s lease will terminate and the Landlord will have no further rights against the student except the following:
   • Rent due and owing, plus rent for one additional month, not to exceed the length of the term of the lease.
   • Actions for damages to the property or other liability arising out of the student’s occupancy of the property.
10. The Landlord understands that all students residing at the property may be jointly responsible for violations of University policies occurring at the property. As a result, all students residing at the property may lose eligibility to reside off-campus, and each lease will be subject to termination.
11. The University may communicate with the Landlord, the student, or both regarding the eligibility and status of the Landlord, the property, and/or the student.
12. The Landlord agrees to share WFU student tenant information with the University in emergency situations. Students will agree to share this information as a part of their off-campus agreement.
13. All properties leased by the Landlord must provide an appropriate parking area (as required by City of Winston-Salem Ordinances) to accommodate all vehicles brought to the property by students residing at the property.
14. All properties leased by the Landlord must provide trash and recycling bins (in accordance with City of Winston-Salem Ordinances).
    • Properties with more than two student occupants must provide two trash bins.
    • Properties with more than four residents must provide at least three roll-off bins or an equivalent waste option.
15. All properties leased by the Landlord must make provisions for lawn maintenance as required by the City of Winston-Salem Ordinances.
16. The Landlord agrees to submit rent and leasing data at least twice annually, as requested by the University.
    • Requested data may include, but is not limited to, leasing volume, average rent, and remaining availability for various terms.
17. The University makes no representations, assumes no liability, and has no responsibility to the student, the Landlord, or any third party with respect to any lease, occupancy, or housing of any student of Wake Forest University. The student assumes full responsibility for the selection, use, or occupancy of such property.
18. The Landlord agrees to work with the University to resolve any issues of non-compliance with these terms and conditions in a timely manner. Failure to do so may result in a change in status with the University, up to removal as a Registered Landlord.
